Waste Disposal & Recycling Drivers

Whether you are responsible for picking up and hauling solid waste, recycled materials, or environmental refuse, employees who work as drivers, helpers, swingmen and in other waste disposal positions often regularly work over Forty (40) hours per week throughout most weeks each year in order to complete assigned routes. Importantly, the Fair Labor Standards Act generally requires employers in the waste management industry to pay overtime compensation for all hours worked in excess of Forty (40) per week even if you are paid a day rate or on an hourly basis.

Many waste services employers automatically deduct time from employees’ actual hours worked each day for “meal breaks” even though bona fide breaks are not taken each day, which can create an overtime violation since many drivers and helpers work over Forty (40) hours per week on a routine basis. In other instances, employers sometimes fail to record all hours worked by drivers and helpers and instead just assume that all employees work a pre-determined schedule.
